Terms of Service

Booking Fees and Deposits
A booking fee of 50% is required at the time of booking, together with a signed contract. Dates are reserved only when the booking fee is paid, either by cash, cheque or bank transfer. Please make cheques payable to “Ross Andrew Photography”. The booking fee is non-refundable; for more information please view the 'Terms and Conditions' section of our website.

You will also have the option to pay via PayPal or Card via our digital quotations.

Travel & Accommodation
Travel charges only apply when the shoot or event is outside of a 40 mile radius. This is again, non-negotiable and must be paid upon the signing of the contract, as part of the 50% deposit if applicable. Travel costs may vary if the team or equipment needed are on-route from another location/job. If any subcontractors are employees as part of services for Ross Andrew Photography (eg. Videographers, Photobooth assistants etc) the client also agrees to cover any potential transport or accommodation fees. Travel fees are calculated at £0.40p per mile, per vehicle, outside of a 40 mile radius. Overnight accommodation is required if locations exceed a 2 hour journey one way.

It is required that Ross Andrew Photography © and any subcontractors or assistants are fed and watered during full day events. This does not have to be meals or beverages guests receive - however a substantial meal will be required to ensure maximum productivity.

 

General Creative Terms
Ross Andrew Photography © shall be granted full creative and artistic licence in relation to the choice of locations and poses used. Our judgement on the style and number of photographs taken shall be deemed correct. Due to changes in the weather and the availability and the willingness of the subjects, Ross Andrew Photography © vow to do our best to honour requested photographs or footage but do not undertake to guarantee any specific picture, video composition, location or group arrangement. Ross Andrew Photography © and any subcontractors will not be held liable for any venue or location limitations including lighting, physical restrictions, permits etc. In the event of insufficient time being allowed: eg. owing to a late start or by not following any suggested time allowances, the client accepts that the quality and quantity of photographs or video footage may be jeopardised. In any event, every effort will be made by Ross Andrew Photography ©.

 

Ross Andrew Photography © and subcontractors remain governed by local laws and guidelines this includes any drone flight permits. If permits or permissions are required this is the client’s responsibility to ensure that necessary precautions or permits are met.

 

Right to terminate services
In regards to health and safety, and the protection of equipment, Ross Andrew Photography © and any subcontractors or assistants reserve the right to terminate coverage and leave the location of any event if the team experience inappropriate, threatening, hostile or offensive behaviour from person(s). If any member of the client’s party or guests damage or vandalise equipment the client will be responsible for any replacement or cleaning fees required - and is responsible for covering or arranging payment of these penalties. Penalties will be depending on the object or equipment in question’s value, as well as any potential loss of income.

 

Creative Copyright
The 1998 Copyright Designs and Patents Act assigns copyright to Ross Andrew Photography © . You, or any persons may not accept the photographs taken under this contract, or allow copies to be made photographically, electronically or by any other means without the permission of Ross Andrew Photography ©. Altering or editing images or video clips with apps or other software, would be an infringement of Ross Andrew Photography ©’s creative right, and may not be a true reflection of our work. We reserve the right to remove unauthorised, processed media at any time. Under no circumstances will copyrighted music be used in any video products, requests for the use of copyrighted music will be denied due to copyright laws. Music will be used from a licensed website for royalty free and copyright free music for the use of video productions.

 

Marketing and Promotional Usage
By signing this contract you are agreeing that Ross Andrew Photography © (and any subcontractors) can use your photos or videos as promotional and marketing materials if decided necessary to do so. When sharing your photos and videos on social media Ross Andrew Photography © has full rights in deciding what description is appropriate. You are also agreeing to tag/mention/link or point towards Ross Andrew Photography ©'s social media and/or website when sharing your images, if requested to do so. If you do not want your photographs or video footage being used for marketing, which includes but is not limited to,  website blog posts, posts onto social media, publication, prints and any other channel to increase brand awareness and encourage future client onboarding, please tick this box: 

 

Delivery of Images and Video Content
In the unlikely event of the total photographic or video failure, injury or sickness beyond control of Ross Andrew Photography ©, the liability will be limited to the full refund of all money paid. 

The delivery of products will be edited photographs/video in high quality JPEGS/MOV files: under no circumstances will the client receive ‘RAW’ or unedited material/products.

If your package includes any prints, albums or canvas’, these designs must be approved by the client, and sent to order/print within 6 months of the design delivery date. If the client fails to approve the designs sent from Ross Andrew Photography © within this 6 month period, Ross Andrew Photography © reserves the right to remove this feature from your package. 

Any products or services that require third party suppliers, as an example, Vanilla Photobooks: who create our Wedding Albums - or Loxley Colour Lab, who fulfil our printing and product orders, shall be deemed as a separate service. Ross Andrew Photography © will not be deemed liable for any delays in delivery, variations in quality, print or finish- despite dealing directly with the Third Party, supplying the services to you, as their customer. Ross Andrew Photography © vow to do our best to maintain consistency of service, and resolve any issues that may arise. Whilst every effort will be made to negotiate competitive prices, Ross Andrew Photography © cannot be held responsible for unexpected increases of list prices etc; which will be the responsibility of the client to cover.

Turnaround time may vary, however we aim to provide all photos and video products between 6 - 8 weeks after the wedding or event date. This may fluctuate depending on the time of year and business of the season.

 

Cancellations and Refunds
In the event of cancellation the following terms apply; the booking fee is non-refundable. If the shoot/event is postponed, then the subject to the availability of Ross Andrew Photography ©, all money paid will be applied to the new date. If the cancellation is within 21 days and the balance has been paid in full, Ross Andrew Photography © will refund all money paid, less £500 as compensation towards loss of income and for any expenses incurred. If Ross Andrew Photography © has to cancel this contract for reasons beyond their control (injury, sickness etc.) their liability shall be limited to a full refund of all moneys paid.
